1. Data controller
Actigence Management Consulting BV ("Actigence", "we") is the controller of the personal data collected through this website and in connection with our consulting engagements. Our activity does not require the appointment of a data protection officer and we have not appointed one; your point of contact is [email protected].
2. Data subjects, data and purposes
The persons concerned are: prospects, the contacts at our clients and partners, as well as the persons whose data appears in the documents that our clients send us for an engagement. The data comes from you, from your organisation or from public professional sources (website, LinkedIn). This policy serves as notice to these persons. We process business contact data (name, position, contact details, exchanges) for three purposes:
- the preparation and performance of our consulting engagements: legitimate interest where our client is a legal entity for which you are the contact, performance of the contract where you are our client;
- invoicing and accounting: legal obligations;
- managing the commercial relationship, including measured B2B prospecting and responses to enquiries from the contact form: legitimate interest.
We do not deliberately collect sensitive data; if engagement documents incidentally contain any, their processing is limited to what is strictly necessary, in full confidentiality. We carry out neither profiling nor automated decision-making.
3. Cookies
This website uses only strictly necessary technical cookies: session_id (session maintenance, one week) and frontend_lang (chosen language, one year). No other cookie is placed; there are neither advertising cookies nor third-party trackers. Should audience-measurement tools be added, this policy and a consent banner would be put in place beforehand.
4. Recipients and processors
Your data is never sold. It is shared only with the service providers necessary for our activity: hosting and IT management of our systems, our chartered accountant and accounting-document exchange platform, office and communication tools. Each is contractually bound to confidentiality and acts only on our instructions.
5. Transfers outside the European Union
We give preference to hosting and service providers established in the European Union. Where a transfer outside the EU is unavoidable, it is subject to appropriate safeguards within the meaning of the GDPR, in particular the European Commission's standard contractual clauses.
6. Retention periods
Contractual and accounting documents are kept for the Belgian legal periods (seven to ten years). Engagement files are kept for ten years after the end of the engagement (contractual limitation period), then deleted, unless returned or destroyed as agreed earlier with the client. Prospecting data is kept for a maximum of three years after the last contact; contact requests left without follow-up are deleted after one year. The website's technical logs are kept for twelve months at most.
7. Security
We apply proportionate technical and organisational measures: encryption of connections, access control, backups, security updates and segregation of environments. In the event of an incident affecting your data, we would inform you in accordance with the GDPR.
8. Your rights
You have the rights of access, rectification, erasure, restriction, objection and portability, under the conditions of the GDPR. In particular, you may object at any time, free of charge and without giving reasons, to our prospecting, by simple e-mail. Requests should be sent to [email protected]; we respond within one month, extendable by two months for complex requests. You may also lodge a complaint with the Belgian Data Protection Authority (autoriteprotectiondonnees.be) or, in France, with the CNIL (cnil.fr).
9. Updates
This policy may be updated; the version in force is published at actigence.eu/privacy. Our general terms and conditions are available at actigence.eu/terms.
